Resolved time and procedure

Total time (working days) is no more than 10 working days, as follows:

a) IPA shall receive application files and check their validity in compliance with the law, transfer them to  Department of Construction for settlement within 01 working day.

b) Department of Construction shall receive and appraise the transferred application files, send request for consulting to the departments and agencies related to the projects (if any), issue and send building permits to IPA to give to the Investors, within 08 working days.

The related departments, agencies and units are responsible for giving their opinion and transfer results to the main responsible authority within 05 working days from the date of receipt of its written request for consulting.

c) IPA shall give result to the Investors at IPA’s office within 01 working day.

Elements

I. In case of new construction work, the application consists of:

1. For vertical construction:

a. Request for issuance of building permit (in the standard form specified in Appendix 6 (Form.1) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

b. 02 sets of design drawings (issued by capable consulting entities). Each set consists of:

-   Drawing of the works position on land lot with a scale of 1/100 - 1/500, together with the outline of works position;

-   Drawing of plane, elevation and main section with a scale of 1/50 - 1/200;

-   Foundation drawing with a scale of 1/100 - 1/200 and foundation section drawing with a scale of 1/50, enclosed with connection diagram with a scale of 1/50 - 1/200 between the construction and the system of transportation infrastructure, water supply, wastewater and rainwater drainage, wastewater treatment, electricity supply, communications and other utilities/technical infrastructure.

With respect to the construction specified in Appendix 3a of Decree No. 46/2012/ND-CP dated 22 May 2012 of the Government, it requires the profile of fire prevention and fighting and a written approval of competent authority relating to fire prevention and fighting for such profile; a written approval of  fire prevention and fighting design. (Not applicable to the construction which does not require documents regarding fire prevention and fighting in the application for building permit).

c. Capability statement of consulting entity and practicing certificate of chief architect.

d. Agreement on total area of construction and architectural plan(s) (applicable to the construction in Area I, Tam Dao Town; the construction in Tay Thien Festival Cultural Center and Dai Lai Report in scope of construction planning with a scale of 1/2000 – in accordance with clause 4, article 9 of the Decision No. 10/2013/QD-UBND dated 28 May 2013).

e. Approval of architectural plan(s) issued by Vinh Phuc People’s Committee (applicable to the construction in the Area I, Tam Dao Town).

g. In case of new buildings with basement adjacent to existing building, the application for building permit shall also be supplemented with the written approval of foundation construction method of the investor to ensure safety for adjacent construction.

2. For horizontal construction in urban (mean the construction works extended horizontally, such as roads, railroads, power lines, telecommunication cables, oil and gas pipelines, water supply pipelines, and other works):

a. Request for issuance of building permit (in the standard form specified in Appendix 6 (Form.2) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

b. Request for issuance of building permit (in the standard form specified in Appendix 6 (Form.2) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

c. 02 sets of design drawings; each set consists of:

-   Outline of the works’ position and alignment;

-   Drawing of general plan and contour drawing with a scale of 1/500 - 1/5000;

-   Drawing of main cross sections of the works with a scale of 1/50 - 1/200;

-   For underground works, it must be supplemented with:

+ Drawing of cross section and longitudinal section with a scale of 1/50 - 1/200;

+ Connection diagram with utilities/technical infrastructure.

d. Capability statement of consulting entity and practicing certificate of chief architect.

e. Other relevant documents (depending on the nature of specific construction works, licensing authority shall require further documents).

3. For construction works of diplomatic missions and international organizations:

a. Request for issuance of building permit (in the standard form specified in Appendix 6 (Form.1) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

b. Notarized or certified copy of land use right certificate in accordance with laws on land;

c. 02 sets of design drawings (issued by capable consulting entities). Each set consists of:

-   Drawing of the works position on land lot with a scale of 1/100 - 1/500, together with the outline of works position;

-   Drawing of plane, elevation and main section with a scale of 1/50 - 1/200;

Foundation drawing with a scale of 1/100 - 1/200 and foundation section drawing with a scale of 1/50, enclosed with connection diagram with a scale of 1/50 - 1/200 with the system of transportation infrastructure, water supply, wastewater and rainwater drainage, wastewater treatment, electricity supply, communications and other utilities/technical infrastructure.

d. Capability statement of consulting entity and practicing certificate of chief architect.

e. Other relevant documents (depending on the nature of specific construction works, licensing authority shall require further documents) and others in compliance with the treaty or agreement signed with the Vietnam Government.

II. In case of phased construction works, the application consists of:

1. For vertical construction:

a. Request for issuance of building permit (in the standard form specified in Appendix 10 (Form.1) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

b. Notarized or certified copy of any kind of land use right certificates in accordance with laws on land, as follows:

-        For rental house (in legal land): House lease contract in compliance with the law, written acceptance/power of attorney of house owner to tenant in order to apply for building permit;

-        For the construction on the land which is allocated by the State authority to the land user (such land must be allowed to lease by the law on land): House lease contract in compliance with the law which must contain the acceptance of the leaser for the leasee to build construction works.

For residential land which is granted with land use right certificate and used to build commercial buildings (such as: karaoke bar, hotel, motel, office, oil and gas station and other construction): Certificate of land-use purpose issued by District/Commune People’s Committee.

c. With respect to the construction specified in Appendix 3a of Decree No. 46/2012/ND-CP dated 22 May 2012 of the Government, it requires the profile of fire prevention and fighting and a written approval of competent authority relating to fire prevention and fighting for such profile; a written approval of  fire prevention and fighting design. (Not applicable to the construction which does not require documents regarding fire prevention and fighting in the application for building permit.)

d. Copy of Business Register Certificate or Investment Certificate.

e. Capability statement of consulting entity and practicing certificate of chief architect.

g. 02 sets of design drawings. Each set consists of:

-   Phase 1:

+        Drawing of the construction site on land lot with a scale of 1/100 - 1/500, together with the outline of works position;

+        Foundation drawing with a scale of 1/100 - 1/200 and foundation section drawing with a scale of 1/50, enclosed with connection diagram with a scale of 1/50 - 1/200 with the system of rainwater drainage, wastewater treatment, water and electricity supplies and communications.

-  Phase 2: Drawing of plane, elevation and main section with a scale of 1/50 - 1/200.

h. Agreement on total area of construction and architectural plan(s) (applicable to the construction in Area I, Tam Dao Town; the construction in Tay Thien Festival Cultural Center and Dai Lai Report in scope of construction planning with a scale of 1/2000 – in accordance with clause 4, article 9 of the Decision No. 10/2013/QD-UBND dated 28 May 2013).

2. For horizontal construction in urban:

a. Request for issuance of building permit (in the standard form specified in Appendix 11 of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

b. Notarized or certified copy of any kind of land use right certificates in compliance with the laws on land; or approval for and agreement on alignment of competent authority; or Decision on approval for alignment planning of competent authority.

c. Copy of Business Register Certificate or Investment Certificate.

d. 02 sets of design drawings. Each set consists of:

-   Outline of the works’ position and alignment with a scale of 1/100 – 1/500;

-   Drawing of general plan with a scale of 1/100 - 1/1000;

-   Drawings for each phase, including:

+        Drawing of main cross sections of the works with a scale of 1/50 - 1/200;

+        For underground works, it must be supplemented with drawing of cross section and longitudinal section with a scale of 1/50 - 1/200 for each phase;

Connection diagram with utilities/technical infrastructure with a scale of 1/100-1/500 for each phase.

e. Capability statement of consulting entity and practicing certificate of chief architect.

III. In case of construction project, the application consists of:

1. Request for issuance of building permit (in the standard form specified in Appendix 12 of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

2. Notarized or certified copy of any kind of land use right certificates in compliance with the laws on land (e.g. land use right certificate, drawing of recovered and allocated land, land allocation decision and certificate of land delivery at the site).

3. Copy of Business Register Certificate or Investment Certificate.

4. Environment protection commitment or approval decision on environmental impact assessment (applicable to the projects specified in Appendix 1 – List of projects for which environmental impact assessment is required, enclosed with Decree No. 80/2006/ND-CP dated 09 August 2006 of the Government).

5. Planning certificate, planning information and agreement on total planning area and architectural plan(s) issued by State authority.

6. Report on design assessment or examination issued by the State authority on construction or qualified consulting entities in accordance with the laws; and written approval for technical design and construction drawing of the investor or project approval decision, enclosed with the written comments on basic design (if any) of State management authorities related to specialist construction in accordance with the law;

7. Agreement on total area of construction and architectural plan(s) (applicable to the construction in Area I, Tam Dao Town; the construction in Tay Thien Festival Cultural Center and Dai Lai Report in scope of construction planning with a scale of 1/2000 – in accordance with clause 4, article 9 of the Decision No. 10/2013/QD-UBND dated 28 May 2013)

8. 02 sets of design drawings. Each set consists of:

-   Drawing of each construction’s site on land lot with a scale of 1/100 - 1/500, together with the outline of works position;

-   Drawing of general plan or general plan for each phase with a scale of 1/100 - 1/500;

-   Drawing of elevation and main section with a scale of 1/50 - 1/200;

-   Foundation drawing with a scale of 1/100 - 1/200 and foundation section drawing with a scale of 1/50, enclosed with connection diagram with a scale of 1/50 - 1/200 between the construction and the system of rainwater drainage, wastewater treatment, water supply, electricity supply and communications.
