Resolved time and procedure
Total time (working day) does not exceed 10 working days. Details are as follows:
a) IPA shall receive application dossiers, check their validity in compliance with the law and later transfer them to the Department of Construction for settlement within 01 working day
If projects are subject to reporting to the provincial Standing Party Committee on their investment policy (i.e. investment projects outside industrial zones located on a slot of 01 ha or more area ). IPA shall examine the application dossiers, instruct the Investors to complete and supplement to them , later report to and consult the Provincial Peopel’s Commitee and the provincial Standing Party Committee on their investment policy.
b) Department of construction shall receive and check the transferred application dossiers if they are compatible with approved general and detailed plannings; coodinate with the related Departments, District People’s Commitee and Commune People’s Commitee and the Investors in fieldwork; consult the related Departments regarding investment projects (if any) within 07 working days.
The relevant Departments and authorities shall provide consultation and transfer results to the Department of Construction within 05 working days from the date of receipt of the written request for consulting of the Department of Construction.
c) The Provincial People's Committee Office shall receive, review related documents and submit proposal on approval of investment location to leadership of the Provincial People's Committee within 01 working day.
d) IPA shall give result to the Investors within 01 working day.
Elements
1. Request for project implementation (not in standard form).
2. The Project’s profile which clearly indicates: investment purpose, nature, scope (total investment and total area in demand), capital recourses; intended investment location (In case where the investor has not yet determined exact position, the investor shall clearly point out its intended investment areas and propose to the provincial People’s Committee, Departments and Agencies to advise on the appropriate position to the nature and scope of investment), portfolio; production lines and technology (if any); investment form, project management form, project implementation schedule and plan, solution of environmental hygiene and fire prevention and fighting and other related recommendations (if any), ... ; and project implementation commitment if approved. (According to Article 7, Chapter 3, Decree No.12/2009/ND-CP, dated 12 January 2009 of the Government on management of construction projects).
* Note: For the projects not included in the planning of the province, the approval of competent authority for amendment of the planning shall be required.
3. Investor’s capacity profile: Business Registration Certificate; annual finance statements for the last 03 years; experience report in the intended investment sectors…(if any).
