Resolved time and procedure

Total time (working day) not exceed 10 days, as follows:

a) IPA shall receive application  files and check their validity in compliance with the law and later then transfer them to Department of Construction for settlement within 01 working day.

b) Department of Construction shall the application files transferred by IPA, appraise such files, issue and send planning certificate to IPA to give to the Investors within 08 working days.

c) IPA shall receive and return result to the Investor at IPA’s office within 01 working day.

Elements

1. Request for issuance of planning certificate (in standard form enclosed with Decision No. 2523/QD-UBND dated 07 August 2009 of the People’s Committee).

2. Decision on and planning drawing of the location; or one of any kind of legal land use right certificate (applicable to the case of no planning on the location).

3. Topographic map with a scale of 1/500 (enclosed with AutoCad drawing file) prepared by consulting entity in compliance with the law (applicable to projects which are being implemented or has the time for location planning of over 12 months from the date of approval for the location).

4. Other relevant documents (at the request of host authority)

Example:

-  With respect to the project which is granted by the provincial People’s Committee with amendment of investment certificate in nature, scope and other contents of the project but not in investment location, the amended investment certificate shall be required; or

-  In case where the investor who was allocated with land enters into an joint venture agreement with other investors, leading that the major investors is not as same as the first investor, the joint venture contract shall be required.
