Resolved time and procedure

Total time (working days) does not exceed: 37 working days for group A projects, 30 working days for group B projects, 25 working days for group C projects. Details are as follows:

a) IPA shall receive application files, check their validity in compliance with the law and later transfer them to the Department of Planning and Investment for settlement within 02 working days.

b) Department of Planning and Investment shall receive the transferred application files; consult the Departments related to the investment projects (if any); appraise, make and send a Report on Appraisal to the Provincial People's Committee Office in the following time-limit: 30 working days for group A projects, 24 working days for group B projects, 20 working days for group C projects.

The relevant Departments are responsible for giving opinion, transferring results to the Department of Planning and Investment in the following time-limit: 12 working days for group A projects, 09 working days for group B projects, 07 working days for group C projects from the date of receipt of written request for consulting of the Department of Planning and Investment.

c) The Provincial People's Committee Office shall receive the Report on Appraisal and related documents, review and submit drafts of decision to leadership of the Provincial People's Committee for approval and transfer results to IPA to give to the Investors, in the following time-limit: 04  working days for group A projects, 03 working days for group B projects, 02 working days for group C projects.

d) IPA shall give result to the Investors within 01 working day.

Elements

Appraisal and approval for Economic and Technical Report of Construction Project with total investment of below 15 million dong

1. Request for appraisal:

-   Request for appraisal of Economic and Technical Report of Construction Project (in standard form of the Circular No. 03/2009/TT-BXD dated 26 March 2009 issued by Ministry of Construction).

-   Request for appraisal of construction project (in standard form of the Decree No. 12/2009/ND-CP dated 10 February 2009 of the Government).

2. Legal documents, including:

-   Initial Approval of Investment (according to the Decision or Official Letter of provincial People’s Committee).  

-   Decision on Investment Location Approval, Decision on Investment Location Adjustment, Decision on Area Extension, Map of Landmark Setting.

-   Decision on approval of alignment plan and the approved alignment plan.

-   Decision on approval of master plan with a scale of 1/500 and relevant maps.

-   Planning Certificate, construction site leveling and reinforcing map.

-   Certification of organization and regular staffs of the authorities.

-   Decision on approval for designing tasks of the investors.

a. Survey Profile (topographic survey, geological survey, hydrographic survey)

-   Decision on approval for pre-design investigation.

-   Report on evaluation results of investigation method set by specialized departments.

-   Investigation results collected by survey consultants.

b. The Project Profile consists of:

-   Project presentation (Presenting the Economic and Technical Report of Construction Project with total investment of below 15 billion).

-   Documents on presentation of basic designs:

+   Estimated total investment (Design estimates, verifying estimates for the project with total investment of below 15 billion dong).

+   Collection of basic design drawings (initial construction design drawings for the verified project with total investment of below 15 billion dong and verification report of the verification agency).

+   Spreadsheet of structure, technology and engineering solution.

c. Consulting Profile consists of:

-   Legal status of design consultant.

-   Legal status of verification agency for the projects with total investment of less than 15 billion dong.

-   Legal status of investment verification agency for the projects to be verified on their total investment.

-   The capacity and experience of the consultants in accordance with the type and level of construction.

-   Certificate of presiding design consultant, survey consultant, estimation officers and estimation and verification officers.

3. Minutes and memorandum of understanding (MOU):

-   Minutes on the results of the survey.

-   Handover minutes.

-   Minutes on determining waste dumping location, construction material mine, transport distance.

+   Minutes of dumping and dredge.

+   MOU of land mining for leveling.

+   MOU of electrical connection.

+   MOU of water connection (water supply and drainage).

4. Overall plan for site clearance. In resettlement cases, it is required a resettlement plan and infrastructure master plan of anticipated resettlement area.

5. Confirmation on capital structure, capital or reciprocal project, payment method (BT, BOT, BTO project or etc.).

6. Approval for Environment Impact Assessment (in accordance with Law on Environmental Protection).

Quantities of Application:  At least 03 sets (Depending on the scale and scope of the project, investors may be required to submit a number of additional application sets to send to other relevant offices and units for their opinions on appraisal and approval of such construction project)
