The new policy takes effect from Feb, 2016
Many important new policies issued by the Government and the Prime Minister, the Ministries and official departments taken effect from Feb – 2016 as follows:
Guiding the implementation of some articles of the Law on Public Investment
The Government issued Decree N0 136/2015/ND-CP guiding the implementation of some articles of the Law on Public Investment. Of which guidance on the classification of programs and projects of public investment; formulation, appraisal, deciding the programs investment policy, investment projects of Group A, Group B and Group C; formulation, evaluation, programs investment decision, investment projects of Group A, Group B and Group C; adjustment program, public investment projects; management of public investment projects without component construction.
Application subjects of the Decree are agencies, organizations and individuals related to public investment activities, management and use of public investment fund.
This Decree shall take effect from Feb 15,2016. The previous regulations contrary to the provisions of this Decree are hereby repealed. /.
Guiding policies on Corporation income tax for environmental protection activities
Circular 212/2015/TT-BTC guiding policies for corporate income tax for environmental protection activities stipulated in Decree 19 / 2015ND-CP of the Government dated 14/02/2015 detailing of some articles of the Law on environmental protection of the Ministry of Finance issued detailed guidelines on the preferential enterprise income tax for environmental protection activities; guide the cost is deducted when determining corporate income tax.
This Circular takes effect from Feb 14, 2016.
Details of the investment field and study feasibility content report of project under the PPP form in the fields of transportation
Circular 86/2015/TT-BGTVT detailed instructions on the field of investment and feasibility study report of investment projects in the form of public-private partnership (PPP) in the field of transportation issued by Minister transport. Circular providing details about the investment field of road, rail, maritime and aviation. Circular also provides details about the content of feasibility study report of the project.
This Circular takes effect from the date of 15/02/2016.
Circular 23/2015 / TT-BKH provisions detailed evaluation report of bids issued by the Minister of Planning and Investment
Circular issued the assessment report form tender and appendices. Circular also provides information about the evaluation of bids, time evaluation of tenders; for submission, appraisal and approval of contractor selection results.
This Circular takes effect from the date of 15/02/2016.
Contractors must buy insurance for employees minimum 100 million / person / service
Decree 119/2015/ND-CP dated November 13, 2015 of the Government providing compulsory insurance in construction investment activities with effect from Feb 10,2016. Accordingly, the construction contractors to purchase insurance for construction workers on site with a minimum coverage of 100 million / person / service.
Also from this date, the investor or contractor, work items that affect public safety; construction investment projects with significant impact on the environment on the list of projects to be carried out environmental impact assessment; works with specific technical requirements, complex conditions of construction required to purchase liability insurance of works during construction.
6 Institutions are allowed to invest indirectly venture abroad
With effect from Feb 15, 2016, the Decree No. 135/2015/ND-CP dated 31/12/2015 of the Government regulations on portfolio investments abroad.
Accordingly, the six organizations licensed proprietary trading portfolio investments abroad include:
- Securities companies, fund management companies;
- The securities investment fund through funds management companies (securities funds), securities investment companies;
- The insurance business enterprise;
- Commercial Bank;
- The general financial company;
- The State Capital Investment Corporation.
Decree provides for self-employment to be indirect investment abroad, the self-employed organization must be granted registration certificate portfolio investment abroad by competent authority (not applicable to the investment Corporation and the state capital business, securities investment funds, securities investment companies).
Circular 53/2015/TT-BCT providing details on registration lists for imported goods, temporary import – re-export of foreign contractors in the construction sector in Vietnam issued by the Minister of Industry and Trade
December 30, 2015 the Ministry of Industry and Trade has issued a circular providing details on the registration lists for imported goods, temporary import – re-export to perform contracts of foreign contractors bidding for construction in Vietnam. This Circular specifies the procedures for registration and adjust the list of imported goods, temporarily imported goods for re-export and it is divided into two cases of direct registration in the Ministry of Industry and Trade or registered online via the internet. In addition, circular are attached to the application form, adjust the list of imported goods, temporary import – re-export serving the construction of buildings.
This Circular taken effect from Feb 12, 2016.
