Resolved time and procedure

Total time (working days) is no more than 10 working days, as follows:

a) IPA shall receive application files and check their validity in compliance with the law, transfer them to Industrial Zone Management Board for settlement within 01 working day.

b) Industrial Zone Management Board shall receive and appraise the transferred application files, send request for consulting to the departments and agencies related to the projects (if any), issue and send building permits to IPA to give to the Investors, within 08 working days.

The related departments, agencies and units are responsible for giving their opinion and transfer results to the main responsible authority within 05 working days from the date of receipt of its written request for consulting.

c) IPA shall give result to the Investors at IPA’s office within 01 working day.

Elements

1. Request for issuance of building permit (in the standard form specified in Appendix 6 (Form.1) of Circular No. 10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction).

In case of request for a temporary building permit, the request must contain the commitment of voluntarily dismantling  of such building as soon as site clearing by the State (01 original);

2. Notarized copy of one of the papers on land use as specified in the laws on land (e.g. land use right certificate or decision on land allocation and recovery issued by competent authority or land lease contract enclosed with certificate of land delivery); work ownership certificate in the case of repair or renovation; power of attorney in case where the construction work’s owner authorizes to other individual or entity to perform the repair and renovation (01 copy);

3. Approval decision on environmental impact assessment (applicable to the projects for which environmental impact assessment is required) or Certificate of environment protection commitment (applicable to the projects for which environment protection commitment is required) – in accordance with the Law on Environment Protection and its implementation guides (01 copy);

4. Design drawings issued by qualified individuals and entities and approved upon the valuation organized by investor in accordance with the laws (02 sets of original). Each set consists of:

-        Drawing of the work’s position on land lot and the lot’s boundaries; contour drawing (for horizontal construction works), connection diagrams with utilities/technical infrastructure outside the work’s fence (e.g. traffic and drainage);

-        Drawing of plane, main elevation and section;

-        Drawing of base plane and base section; drawings of load-bearing structure (base, frame, walls, load-bearing roof);

-        Drawings of fire protection and fighting system which has been evaluated and approved with respect to the list of works required to have evaluation and approval of explosion, fire prevention and fighting plan in accordance with the laws on fire protection and fighting;

In case of repair or renovation, Drawings on location, items to be renovated are required. If it is possible to affect on the work’s structure, the investor must report the results of quality evaluation and survey of old structures relating to the items to be renovated and the reinforcement measures which ensure the eligibility for repair and renovation, together with photos of the current state of the works and its adjacent works.

5. Business Register Certificate (applicable to DDI enterprise) or Investment Certificate (applicable to FDI enterprise) together with its presentation of the investment project (01 copy);

6. Decision on approving the project (issued by the investor) together with the written approval for the project issued by competent authority and the written opinion on basic design (if any) issued by the State authority as prescribed by the law (01 set of original);

7. Assessment report and written approval of technical design and construction drawing; Design examination report made by the State authority on construction or qualified consulting entities in accordance with the laws, enclosed with drawings of main load-bearing signed and sealed by the design entities or individuals;

8. Approval of construction measures to ensure the safety to new building and adjacent buildings (applicable to new buildings with basement adjacent to existing buildings (01 original);

9. Capability and experience statement of architecture organizations or architects as chief architect (01 copy) (in standard form specified in Appendix 9 of Circular No.10/2012/TT-BXD dated 20 December 2012 of the Ministry of Construction guiding a number of articles of Decree No. 64/2012/BD-CP dated 4 September 2012 of the Government regarding issuance of building permit), enclosed with notarized copy of practicing certificate of the chief architect.
