Appraisal and approval for Environmental Impact Assessment

Resolved time and procedure

Total time (working day) does not exceed 30 working days as follows:

a) IPA shall receive application files and check their validity in compliance with the law, transfer them to the Department of Natural Resources and Environment for settlement within 01 working day.

b) Department of Natural Resources and Environment shall receive, appraise the transferred application files and send a report to enclosed with the application files to the provincial People’s Committee Office, within 16 working days

c) The Provincial People's Committee Office receive documents, review the settlement process of application files, draft and send decision to leadership of the Provincial People’s Commitee for signing and approval; and later then transfer the results to IPA to give to the Investors within 03working days.

d) IPA shall give result to the Investors at IPA’s office within 01 working day.

Elements

1. 01 request for appraisal and approval for Environmental Impact Assessment (in standard form as specified in Appendix 2.3 of Circular No. 26/2011/TT-BTNMT dated 18 July 2011).

2. 01 Presentation of investment project (Feasibility study report).

3. 09 Environmental Impact Assessment (in standard form as specified in Appendix 2.4 and Appendix 2.5 of Circular No. 26/2011/TT-BTNMT dated 18 July 2011).

4. 01 CDs containing the entire contents of environmental impact assessment.

5. With respect to the subjects of environmental impact assessment being: Projects to renovate, expand, upgrade or raise the capacity of production, trade or service enterprise up to or equivalent to the number specified in items 1 thru 143 of the Appendix II attached with Decree No. 29/2011/ND-CP, which has approved environmental impact assessment, or registered or certified environmental protection commitment, or certified registration of environmental standard attainment, or approved or certified environmental protection schemes, the application dossier shall be, in addition to the documents mentioned in item 1, 2, 3, 4 above, added a copy of approval of  environmental impact assessment, certificate of environmental standard attainment,  approval or certificate of environmental protection schemes or the document(s) proving that environmental protection commitment already registered.

6. In case of re-elaborate environmental impact assessment: which is applicable to the project which has an approved environmental impact assessment has not yet been put into operation for the reasons of change of the project’s location, project suspension at least in 36 months as from the date of approval for environmental impact assessment, increase in scale or capacity of production, trade or service or change of technology leading to a broader scope of impact or greater adverse impacts on the environment (not caused by wastes) or an increase in total volume of wastes or generation of new kinds of waste or wastes with contents of pollutants higher than previously calculated or forecast in the approved environmental impact assessment, the application dossier shall be, in addition to the documents mentioned in item 1, 2, 3, 4 above, added a copy of decision on approval of  previous environmental impact assessment.

Statutory fee: VND 5,000,000 (as stipulated in Decision No.55/2007/QD-UBND dated 21 September 2007).
