Resolved time and procedure

Total time (working days) does not exceed 09 working days in case of non-consulting related authorities or 12 working days in case of consulting related authorities as from the date when submitting application file at IPA’s office. Details are as follows:

a) The eligible enterprise shall submit 01 application file to Vinh Phuc Investment Promotion Agency (IPA). Within 01 working day, IPA shall transfer it to the main responsible authority for appraisal (and make 01 set of copies for following up and filing).

b) Process of application appraisal:

-    In case of non-consulting related authorities: Main responsible authorities shall appraise application files, prepare and send a report on appraisal to the Chairman of People's Committee so that he/she could issue and send decision on enterprise assistance to the Provincial People's Committee Office no later than 03 working days as from the date of receipt of application file.

-   In case of consulting related authorities: Within 02 working days as from the date of receipt of application file, main responsible authorities must send a consulting letter (enclosed with a set of copies of application file) to related authorities. Accordingly, the related authorities are obliged to consider if all/any conditions to get assistance are satisfied by enterprise, and issue a written response within 02 working days as from the date of receipt of consulting letter.

Beyond this time limit, if the related authorities do not response yet, it shall be deemed that they agree and are responsible for content of the consulting letter. No later than 02 working days as from expiration date of response, main responsible authority shall prepare and submit a report on appraisal to the Chairman of People's Committee so that he/she could issue and send decision on enterprise assistance to the Provincial People's Committee Office.

-    If any application file does not satisfy conditions to get assistance, main responsible authority shall issue a written refusal to enterprise (and to IPA for following up) within 03 working days for the case of non-consulting related authorities, within 06 working days for the case of consulting related authorities, as from the date of receipt of application file.

c) No later than 02 working days as from the date when receiving report of appraisal, the Provincial People's Committee Office shall review and submit it to the Chairman of People's Committee for signing on and issuing decision on enterprise assistance. The decision on enterprise assistance shall be sent to IPA, Industrial Zone Management Authority, Department of Planning and Investment, Department of Finance, Department of Industrial and Trade, provincial State Treasury and the enterprise which is entitled to assistance.

d) IPA shall delivery all assistance to the Investors within 03 working days as from the date of receipt of decision on enterprise assistance and final account statement in accordance with current legislation.

Elements

1. Written request of support, which clearly indicates the results and progress of project implementation at the time of this request and the support amount should be granted;

2. Copy of Investment Certificate, decision on land-use change and land lease or factory lease agreement;

3. Copy of contracts, bills, invoices, receipts relating to the enterprise’s expenses as specified in Article 3, Article 4 and Article 5 of Regulation on support to enterprises investing in the project for manufacturing supporting industry products in the industrial zones of Vinh Phuc province (Enclosed with the Decision No. 47/2012/QD-UBND dated 14 November 2012 of Vinh Phuc People’s Committee)

4. List of products;

5. Copy of supply product contract for secondary manufacturing enterprise; copy of payment invoices and/or contract completion certificate (if any).
