Department of Fire Preventing and Fighting Police

Resolved time and procedure

Total time (working days) is not more than 07 working days, as follows:

a) IPA shall receive application files and check their validity in compliance with the law, transfer them to the Department of Fire Preventing and Fighting Police for settlement within 01 working day.

b) The Department of Fire Preventing and Fighting Police shall receive and appraise the transferred application files, issue certificates of fire preventing and fighting and later send them to IPA in order to give to the Investors within 05 working days.

c) IPA shall give result to the Investors at IPA’s office within 01 working day.

Elements

1. With respect to project with 01 step of appraisal:

Appraisal and approval for technical design and construction drawing of fire prevention and fighting:

1.1. Request for appraisal and approval for fire prevention and fighting profile of the investor; in case where the representative of the investor submits the application on behalf of the investor, such representative must present its power of attorney;

1.2. Copy of written approval of competent authority for the investment project or planning certificate or land use right certificate of any kind;

1.3. Drawing and description of technical design or construction drawing which contains the contents of fire prevention and fighting as promulgated in Clause 1, 2, 3, 4, 5 and 6 of Article 14 of the Decree No. 35/2003/ND-CP;

1.4. Capacity profile of the consulting entity of fire prevention and fighting: Notarized copy of Business Registration Certificate; Chief architect, Director or Deputy Director must have adequate capability of construction design as required by the law or bachelor degree or higher degree of fire prevention and fighting; and the architect(s) who makes technical design and construction drawing of fire prevention and fighting in person shall be required a suitable bachelor degree or higher degree for his/her design tasks;

1.5. Note: The construction with fire and explosion hazard as referred to in section 13, 14 and 19 of Appendix 3 of Decree No.46/2012/ND-CP, dated 22 May 2012 shall be required to obtain a written approval of construction site issued by the Department of  Fire Prevention and Fighting before preparing design and/or drawings of the construction.

The application dossier for approval of construction site consists of:

-        Written request for investigation and approval for the investor’s construction site regarding fire prevention and fighting standards which specifies the scale, nature, and characteristics of explosive and inflammability hazard of the planned construction, as well as the characteristics, conditions and compatibility of the land where the construction is planned to be built;

-        Copies of the land use right certificate or construction or house ownership certificate of all kinds;

Drawings and documents which clearly indicate the terrain of construction site related to fire prevention and fighting, such as: fire resistance rating of the construction, the distance from the construction to its surrounding constructions, wind direction, the construction’s elevation.

2. With respect to project with 02 steps of appraisal: 

2.1. Appraisal and approval for basic design of fire prevention and fighting

2.1.1. Written request for consideration and recommendation on fire prevention and fighting solutions of the investor or the organization or agency (if being authorized by the investor) which appraises and approves the investor’s project, enclosed with the power of attorney of the investor to such organization or agency;

2.1.2. Copy of written approval for investment from competent authorities;

2.1.3. Drawing and  description of basic design demonstrating the requirements for fire prevention and fighting solutions as prescribed in Clause 1, 2, 3 and 4 of Article 13 of the Decree No. 35/2003/ND-CP.

2.2. Appraisal and approval for technical design and construction drawing of fire prevention and fighting:

3. Appraisal and approval for design profile or planning of fire prevention and fighting

3.1. Written request for consideration and recommendation on fire prevention and fighting solutions of the investor or the organization or agency (if being authorized by the investor) which appraises and approves the investor’s project, enclosed with the power of attorney of the investor to such organization or agency;

3.2. Documents and drawings of detailed planning with a scale of demonstrating the requirements for fire prevention and fighting solutions as prescribed in Clause 1, 2, 3 and 4 of Article 13 of the Decree No. 35/2003/ND-CP.

Quantities of the application: 02 sets, certified by the investor. The dossier in foreign languages must be enclosed with the Vietnamese translation. The agency, organization or individual that requests the appraisal and approval must be responsible for the accuracy of such translation.
